Welcome to bumzdiapers.com (the "Site"), owned and operated by Bumz, Inc. ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Site, including any content, functionality, and services offered on or through the Site, and your purchase of products from us.

By accessing, browsing, or placing an order on the Site, you agree to be bound by these Terms and our Privacy Policy (incorporated herein by reference). If you do not agree, do not use the Site or purchase from us.

If we cancel an order, we will attempt to notify you and issue a refund for any amounts already paid.
• Product descriptions, images, and pricing are provided in good faith but may contain errors. We are not liable for typographical or photographic errors.
• Prices are in USD and exclude shipping, taxes, duties, and customs fees (unless stated otherwise). You are responsible for all applicable taxes.

3. Payment

• We accept major credit/debit cards and other payment methods displayed at checkout.
• By providing payment information, you represent that you are authorized to use that method.
• Payment is processed at the time of order placement. Title to products passes to you upon shipment.

4. Shipping and Delivery

• Shipping times and costs are estimated and displayed at checkout. Actual delivery may vary due to carrier issues, location, or other factors beyond our control.
• Risk of loss or damage passes to you upon delivery to the carrier (FOB shipping point).
• We are not responsible for delays, lost packages, or customs issues for international orders.

5. Returns, Refunds, and Exchanges

• We accept returns and exchanges in accordance with our Return Policy (linked separately).
• Products must be unused, in original packaging, and returned within the stated timeframe.
• Certain items (e.g., opened hygiene products) may be non-returnable for health and safety reasons.
• Refunds are issued to the original payment method, minus shipping costs (unless the return is due to our error).

6. Intellectual Property

• The Site, including text, graphics, logos, images, and software, is owned by Bumz, Inc. or its licensors and protected by U.S. and international copyright, trademark, and other laws.
• You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the Site without our prior written consent.

8. Limitation of Liability

• To the fullest extent permitted by law, Bumz, Inc., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, products, or these Terms, even if advised of the possibility of such damages.
• Our total liability shall not exceed the amount you paid for the product(s) giving rise to the claim.
• Some jurisdictions do not allow the exclusion or limitation of certain damages; in those cases, liability is limited to the extent permitted by law.

9. Disclaimer of Warranties

• The Site and products are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not warrant that the Site will be error-free, secure, or uninterrupted.

10. Indemnification

You agree to indemnify, defend, and hold harmless Bumz, Inc. and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.

11. Governing Law and Dispute Resolution

• These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.
• Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Casper, Wyoming.
• You agree to waive any right to a jury trial or to participate in a class action.

12. Miscellaneous

• If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect.
• Our failure to enforce any right does not constitute a waiver.
• These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and Bumz, Inc.
